What does surrogacy mean?

As Wikipedia says, gestation or surrogacy, or also called surrogacy or surrogacy or surrogacy is the practice by which a woman agrees to get pregnant, carry the pregnancy to term and give birth to a child, all of it for another person or partner, which are or become parents of the child.

When did this modality start?

The beginning of this "commercial" mode of pregnancy dates back to the years 1970, and since then it has been raising strong ethical controversies, legal and social.

There are multiple positions regarding surrogacy, those who understand that it is a right to reproduction and the exercise of individual freedom, and those who understand that it is a kind of exploitation of women of low socio-economic class.

Is surrogacy legal?

Surrogacy is regulated in some countries, there is a lack of standards or significant regulatory gaps in other countries, which generates great insecurity for future parents and minors born by this practice.

Recently a debate has been opened in Spain on this figure of gestation, since in our country is prohibited but there is no penalty for non-compliance, which leads to the irregular practice of the entire process with the consequent Legal uncertainty of what response the Government will give to the practice of families that resort to third countries to order and collect their children who are pregnant by a foreign woman.

Third party intervention

To the above we have to add the intervention of third parties in the process. exist various agencies Spanish women who act as intermediaries, there is a payment for some services, illegal in Spain, for Spanish citizens to process the entire process abroad to have a child by surrogacy.

Spanish citizens who resort to surrogacy are Canada, USA, United Kingdom, India, Nepal, Mexico, Thailand, Ukraine, Russia, Greece, Georgia and South Africa.

How much does surrogacy cost?

Prices for the process can go since the 30.000 to the 60.000 euros depending on the country, implantation attempts of fertilized embryos, and the services offered to parents.

Social controversy in Spain

Regarding the intermediary agencies, there has been a movement by the Government in recent days that is generating social controversy, since from the executive, through the Ministry of Justice, has requested the Attorney General of the State a official investigation on the activities of the agencies operating in Spain to define and calibrate your skills well.

  • From the political parties, it is only Citizens who are in charge of legislating this reproductive practice, what do you propose it to be “altruistic and that the woman is willing to bear a third-party child voluntarily”, without receiving remuneration, but yes “compensation” to cover pregnancy expenses, and under the supervision of an official system. Position that does not receive the support of any other political group.
  • From the PSOE itself, PP and United We can attack this figure when considering, same as feminist collectives, that with this practice women are attacked and exploited.
  • Own European Parliament opposedto surrogacy in which, according to its Resolution, the woman's body and its reproductive functions were used as commodity.

From some areas, as expressed Núria González, author of the book “rent bellies”, is about “a lucrative business that has a baby as a product and that rents a woman's body”, compromises your dignity, adding that these abusive contracts are based on the “extreme vulnerability” of pregnant women, who are usually poor women. Specially in Ukraine, one of the countries in the crosshairs of Minister Delgado.

The truth is that it is a social reality that, in my judgement, It should be addressed and regulated, thus avoiding the discrepancies and controversies that exist today., trying to the extent possible that this practice avoids the exploitation of women, make clear the rules that those who intend this type of reproduction must abide by, and that regulates the profit of some who, under the guise of wanting to help couples with difficulties or inability to have children, obtain important economic benefits.

You cannot go against a social demand already established and rooted in Spain, therefore ... let's regulate it.
